Our Website

All text, images and content of this website are and remain the property of Rusk Design. Logos, characters and designs are the property of the respective clients. It is illegal to download, reproduce or use any images that appear on this website for advertising or commercial purposes without written consent from us. Use of this web site is taken as acceptance of these conditions.

Our Terms and Conditions detailed below are legally binding to any organization or person that chooses to use the services of Rusk Design. The term 'Client' and 'you' refers to any organization or person using our services. The terms 'us' and 'we' refer to Rusk Design.

General Working Agreement

When a Client instructs Rusk Design to work on a project, we ask that you answer any communication from us in a timely manner. If a period of 30 days elapses without response from you, we may at our discretion terminate the project. In this instance, the Client will be responsible for the payment of any work carried out to date on the project, and any losses incurred by Rusk Design.

Proofing and Authors Amends

When we present our first set of visuals for a project, we allow time within our quote for a set of amends. There is no charge for this first set of amends, i.e. corrections to spelling or grammar and changes to the general styling or design of the project. However, if you require replacement of text or images, or alterations that differ from the original brief, then these are classed as Authors Amends and will be chargeable to the Client. We will advise you if this occurs and re-quote for the work involved. Any further amends, after the first set of amends, are also considered authors amends and will therefore be chargeable. Whilst we make every effort to ensure accuracy and quality, Rusk Design can not accept liability for errors overlooked after the project has been approved. Approving the proof is the customers responsibility before the job can proceed to production.

Rusk Design now use electronic proofing systems for convenience, speed and efficiency. Electronic proofs closely represent the image colour and text placement, but they are not exact. Your monitor's settings will differ from that of the designers. Colours may vary depending on your monitor's brightness, contrast and colour adjustment settings. The image may appear larger or smaller than actual production size depending on the resolution of your monitor. We cannot be responsible for final printed colours due to the different printer settings of each outside printing company. If you require exact colour management please select from the Pantone Matching System.

In the unlikely event of negligence on our part or misinterpretation of a brief, Rusk Design’s total liability to the Client under any circumstance will not exceed the net amount invoiced for any damaged, defective or undelivered items.

Photographs, images and text supplied by the Client must be your own or licensed for use by you. Rusk Design cannot be held responsible for any breach of copyright or any other right caused by reproduction of materials supplied by the Client.

All work created by Rusk Design remains the property of Rusk Design until paid for in full. As part of the design process we may provide alternative designs or layouts. Only the design for the final article is assigned to the Client, all other designs remain the property of Rusk Design. Development stages, working files for illustrations, photo composites and page make-up, remain the property of Rusk Design and will be archived for 18 months then erased at our discretion.

Bespoke photography/images taken by our photographers are intended for the exclusive use by the Client. You may not sell, lease or loan these images without our permission. Stock photography obtained form royalty free image websites/libraries are purchased by us for a specific job/project. They are licenses for ONE USE ONLY. If the Client is in breach of this agreement, and the royalty free image websites/libraries take legal action, Rusk Design will not be held responsible for the Client’s actions. If there is any doubt about rights to re-use elements of the design please contact us to make permissions clear.

Rusk Design reserves the right to display completed work in our website, portfolio and marketing material to potential Clients.

Payment

All accounts to be paid in full (including VAT) within 30 days from the date of our invoice. Payment terms will be clearly stated on your invoice. For new customers, we may ask for 50% of the total invoice amount to be paid up front and the remainder to be paid COD. These terms will be clearly stated on our quotation.

Failure to pay in full within the designated time period, at our discretion, may result in interest being charged to the invoiced amount and a compensation fee in line with The Late Payment of Commercial Debts (interest) Act 1998. The interest charge will be 8% above the Bank of England base rate, and will be charged monthly until the invoice is paid in full.

Rusk Design is committed to protecting your privacy. Any information we collect from you is used only to process your order and to provide you with the best possible service. We will not email you in the future unless you have given us your consent or there is work produced that we need to address. We will give you the chance to refuse any marketing email from us at any point in the future.

The information we will collect from you in order to work on your design project includes your name, address, phone number, and email address. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies, please let us know and we will delete or correct it promptly.

Currently there is only one cookie set by this website directly. Our web host (Namesco) uses the cookie called "X-Mapping-kjicghkc" to distribute web traffic among its servers more efficiently. It does not collect personal information and expires when you leave our site.

Our web host (Namesco) also provides us with anonymous site statistics which can tell us, for example, which web pages are most frequently visited.
